江西省創新完善體制機制推動招標投標市場規范健康發展實施意見

(公開征求意見稿)

為貫徹落實《國(guo)務院辦公廳關于(yu)創新(xin)完(wan)善體制機(ji)制推動(dong)招標投標市場規范健康發(fa)(fa)展(zhan)的意見(jian)》(國(guo)辦發(fa)(fa)〔2024〕21號)(以下簡稱(cheng)《意見(jian)》),加(jia)快推動(dong)我省招標投標市場規范健康發(fa)(fa)展(zhan),結(jie)合我省實際(ji),現提出如下貫徹落實意見(jian)。

一、完善招標投標制度規則

1.健全政(zheng)(zheng)策制度(du)體(ti)系。招標(biao)(biao)投標(biao)(biao)法及其實施條例(li)修訂后,適時推(tui)進修訂《江西省實施<招標(biao)(biao)投標(biao)(biao)法>辦法》。省級(ji)有關行(xing)(xing)業行(xing)(xing)政(zheng)(zheng)主管部門應制定完(wan)善(shan)本行(xing)(xing)業電子招標(biao)(biao)投標(biao)(biao)交易規(gui)則和(he)監管機制,建立健全本行(xing)(xing)業招標(biao)(biao)投標(biao)(biao)活動信用評價體(ti)系。

2.加強制(zhi)(zhi)(zhi)度(du)規則(ze)管(guan)理(li)。建立全省(sheng)(sheng)招(zhao)(zhao)標(biao)(biao)投(tou)標(biao)(biao)政(zheng)策(ce)文(wen)件(jian)(jian)管(guan)理(li)機制(zhi)(zhi)(zhi)。省(sheng)(sheng)發展(zhan)改革委會同省(sheng)(sheng)級有關行業行政(zheng)主管(guan)部門編(bian)制(zhi)(zhi)(zhi)全省(sheng)(sheng)招(zhao)(zhao)標(biao)(biao)投(tou)標(biao)(biao)政(zheng)策(ce)文(wen)件(jian)(jian)目(mu)錄(lu),通過(guo)省(sheng)(sheng)公(gong)(gong)(gong)共資源(yuan)交易平(ping)(ping)(ping)臺公(gong)(gong)(gong)布并動(dong)態更(geng)新,未(wei)(wei)納入目(mu)錄(lu)的政(zheng)策(ce)文(wen)件(jian)(jian)不得(de)(de)作為監管(guan)依(yi)據。政(zheng)策(ce)制(zhi)(zhi)(zhi)定(ding)機關應認真執(zhi)行《招(zhao)(zhao)標(biao)(biao)投(tou)標(biao)(biao)領域公(gong)(gong)(gong)平(ping)(ping)(ping)競爭審(shen)查(cha)規則(ze)》,嚴格落實公(gong)(gong)(gong)開征求意見(jian)、合法(fa)性審(shen)查(cha)、公(gong)(gong)(gong)平(ping)(ping)(ping)競爭審(shen)查(cha)等要求,不得(de)(de)干(gan)涉招(zhao)(zhao)標(biao)(biao)人、投(tou)標(biao)(biao)人自(zi)主權,禁止在(zai)區域、行業、所有制(zhi)(zhi)(zhi)形式等方面(mian)違(wei)法(fa)設置限制(zhi)(zhi)(zhi)條件(jian)(jian)。除法(fa)律、法(fa)規或者國(guo)務院規定(ding)的公(gong)(gong)(gong)平(ping)(ping)(ping)競爭審(shen)查(cha)例外情(qing)形外,未(wei)(wei)經公(gong)(gong)(gong)平(ping)(ping)(ping)競爭審(shen)查(cha)或者經審(shen)查(cha)存在(zai)排除、限制(zhi)(zhi)(zhi)競爭情(qing)形的,不得(de)(de)出臺有關制(zhi)(zhi)(zhi)度(du)文(wen)件(jian)(jian)、政(zheng)策(ce)措施(shi)和示(shi)范文(wen)本。

3.統一(yi)(yi)招(zhao)標文(wen)(wen)(wen)(wen)件(jian)(jian)示范(fan)(fan)文(wen)(wen)(wen)(wen)本(ben)。省級有關行(xing)業(ye)(ye)行(xing)政主管(guan)部門應依據國家示范(fan)(fan)文(wen)(wen)(wen)(wen)本(ben)和(he)行(xing)業(ye)(ye)實際,分(fen)類制定完善(shan)勘察、設(she)計、監理、施工、總承(cheng)包等(deng)本(ben)行(xing)業(ye)(ye)統一(yi)(yi)的招(zhao)標文(wen)(wen)(wen)(wen)件(jian)(jian)示范(fan)(fan)文(wen)(wen)(wen)(wen)本(ben),并在省公共(gong)資源(yuan)交易平(ping)(ping)臺(tai)發布。鼓(gu)勵推行(xing)模塊(kuai)化(hua)(hua)招(zhao)標文(wen)(wen)(wen)(wen)件(jian)(jian)示范(fan)(fan)文(wen)(wen)(wen)(wen)本(ben),推進數字化(hua)(hua)智能化(hua)(hua)評審(shen)。示范(fan)(fan)文(wen)(wen)(wen)(wen)本(ben)應落實全(quan)國統一(yi)(yi)的市場準入條件(jian)(jian),尊重和(he)保(bao)(bao)障招(zhao)標人編制招(zhao)標文(wen)(wen)(wen)(wen)件(jian)(jian)的自主權,支持首臺(tai)(套)重大技(ji)術裝備平(ping)(ping)等(deng)參與投(tou)標,支持廣(guang)大中小企業(ye)(ye)、民營企業(ye)(ye)平(ping)(ping)等(deng)參與投(tou)標,引導招(zhao)標人合理設(she)置(zhi)綠色采購標準,落實環保(bao)(bao)、節(jie)能、低碳要求。

二、規范招標投標主體行為

4.強化招(zhao)(zhao)(zhao)標(biao)(biao)(biao)人主(zhu)體(ti)地位。保障招(zhao)(zhao)(zhao)標(biao)(biao)(biao)人法定權利(li),尊重(zhong)招(zhao)(zhao)(zhao)標(biao)(biao)(biao)人在(zai)選擇代(dai)理(li)機構、委派(pai)代(dai)表參加評標(biao)(biao)(biao)、確定中(zhong)標(biao)(biao)(biao)人等方(fang)面(mian)依法享有的自主(zhu)權,落實(shi)招(zhao)(zhao)(zhao)標(biao)(biao)(biao)人在(zai)組織招(zhao)(zhao)(zhao)標(biao)(biao)(biao)、處理(li)異議、訂約履(lv)約等招(zhao)(zhao)(zhao)標(biao)(biao)(biao)全過程的主(zhu)體(ti)責(ze)任。推行(xing)招(zhao)(zhao)(zhao)標(biao)(biao)(biao)文件提前(qian)公(gong)示(shi),加大招(zhao)(zhao)(zhao)標(biao)(biao)(biao)公(gong)告、中(zhong)標(biao)(biao)(biao)合同、履(lv)約信息公(gong)開(kai)力度,招(zhao)(zhao)(zhao)標(biao)(biao)(biao)公(gong)告中(zhong)應(ying)載明招(zhao)(zhao)(zhao)標(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)行(xing)政監督(du)部門名稱、電話(hua)等信息。探索建(jian)立依法必須招(zhao)(zhao)(zhao)標(biao)(biao)(biao)項目(mu)的招(zhao)(zhao)(zhao)標(biao)(biao)(biao)文件公(gong)平(ping)競爭審(shen)查(cha)機制,由招(zhao)(zhao)(zhao)標(biao)(biao)(biao)人在(zai)招(zhao)(zhao)(zhao)標(biao)(biao)(biao)文件發布(bu)前(qian)實(shi)施(shi)公(gong)平(ping)競爭審(shen)查(cha)。招(zhao)(zhao)(zhao)標(biao)(biao)(biao)人應(ying)認真(zhen)審(shen)查(cha)評標(biao)(biao)(biao)委員(yuan)會提交的評標(biao)(biao)(biao)報告,發現異常情形(xing),依法依規復核和糾正。

5.健全(quan)招(zhao)(zhao)標(biao)(biao)代理(li)(li)(li)機(ji)(ji)構(gou)(gou)服務機(ji)(ji)制。制定招(zhao)(zhao)標(biao)(biao)代理(li)(li)(li)機(ji)(ji)構(gou)(gou)及(ji)從業(ye)(ye)人(ren)(ren)(ren)員(yuan)(yuan)管(guan)理(li)(li)(li)辦法(fa),推(tui)動(dong)(dong)招(zhao)(zhao)標(biao)(biao)代理(li)(li)(li)行業(ye)(ye)自律。建立招(zhao)(zhao)標(biao)(biao)代理(li)(li)(li)機(ji)(ji)構(gou)(gou)動(dong)(dong)態管(guan)理(li)(li)(li)和(he)評(ping)價(jia)(jia)制度,將招(zhao)(zhao)標(biao)(biao)代理(li)(li)(li)機(ji)(ji)構(gou)(gou)納(na)入信(xin)用(yong)評(ping)級管(guan)理(li)(li)(li)。開展招(zhao)(zhao)標(biao)(biao)采(cai)購專業(ye)(ye)人(ren)(ren)(ren)員(yuan)(yuan)能(neng)力評(ping)價(jia)(jia)。強化招(zhao)(zhao)標(biao)(biao)代理(li)(li)(li)機(ji)(ji)構(gou)(gou)行業(ye)(ye)監管(guan),加(jia)大治理(li)(li)(li)招(zhao)(zhao)標(biao)(biao)代理(li)(li)(li)領域亂(luan)收費,打擊價(jia)(jia)外加(jia)價(jia)(jia)等價(jia)(jia)格違法(fa)行為,對(dui)嚴重違法(fa)的招(zhao)(zhao)標(biao)(biao)代理(li)(li)(li)機(ji)(ji)構(gou)(gou)及(ji)其(qi)直接責任(ren)人(ren)(ren)(ren)員(yuan)(yuan)依法(fa)予以處理(li)(li)(li)并實行行業(ye)(ye)禁入。

6.加(jia)強投(tou)(tou)標(biao)(biao)(biao)(biao)行為(wei)管理(li)(li)。規(gui)范(fan)投(tou)(tou)標(biao)(biao)(biao)(biao)文(wen)(wen)(wen)件(jian)(jian)制(zhi)(zhi)作管理(li)(li),實行計價(jia)軟件(jian)(jian)實名制(zhi)(zhi),投(tou)(tou)標(biao)(biao)(biao)(biao)人(ren)(ren)(ren)應使用(yong)本企(qi)(qi)業的計價(jia)軟件(jian)(jian)編(bian)(bian)制(zhi)(zhi)投(tou)(tou)標(biao)(biao)(biao)(biao)報價(jia)文(wen)(wen)(wen)件(jian)(jian)。投(tou)(tou)標(biao)(biao)(biao)(biao)人(ren)(ren)(ren)的企(qi)(qi)業資(zi)質、從業人(ren)(ren)(ren)員資(zi)格(ge)等信息應當真實有(you)效。鼓勵招(zhao)(zhao)標(biao)(biao)(biao)(biao)人(ren)(ren)(ren)在招(zhao)(zhao)標(biao)(biao)(biao)(biao)文(wen)(wen)(wen)件(jian)(jian)中明確(que),工程業績(ji)應當在全國建(jian)筑市場監(jian)管公(gong)共服(fu)務平(ping)臺等官方平(ping)臺可(ke)查詢(xun)。不(bu)(bu)同投(tou)(tou)標(biao)(biao)(biao)(biao)人(ren)(ren)(ren)不(bu)(bu)得(de)委托同一單(dan)位(wei)或(huo)者(zhe)個人(ren)(ren)(ren)編(bian)(bian)制(zhi)(zhi)投(tou)(tou)標(biao)(biao)(biao)(biao)文(wen)(wen)(wen)件(jian)(jian)或(huo)辦(ban)理(li)(li)其他投(tou)(tou)標(biao)(biao)(biao)(biao)事宜,不(bu)(bu)得(de)從同一投(tou)(tou)標(biao)(biao)(biao)(biao)單(dan)位(wei)或(huo)同一自然(ran)人(ren)(ren)(ren)的計算機(ji)下載招(zhao)(zhao)標(biao)(biao)(biao)(biao)文(wen)(wen)(wen)件(jian)(jian)、上傳投(tou)(tou)標(biao)(biao)(biao)(biao)文(wen)(wen)(wen)件(jian)(jian)。加(jia)強建(jian)造(zao)師管理(li)(li),防止冒名頂替,從嚴(yan)(yan)控制(zhi)(zhi)中標(biao)(biao)(biao)(biao)單(dan)位(wei)更換建(jian)造(zao)師,特(te)殊原因需更換的嚴(yan)(yan)格(ge)按規(gui)定辦(ban)理(li)(li)變更手(shou)續。全面(mian)排查整治建(jian)造(zao)師掛靠現象。

三、完善招標投標評標定標機制

7.優化評(ping)(ping)標(biao)(biao)(biao)(biao)方法(fa)(fa)。省級有關行(xing)業行(xing)政主(zhu)管(guan)部門應(ying)制定完善工(gong)程建設領域(yu)項(xiang)目(mu)施工(gong)、監理(li)、設計等評(ping)(ping)標(biao)(biao)(biao)(biao)辦法(fa)(fa)。在(zai)勘(kan)察設計項(xiang)目(mu)評(ping)(ping)標(biao)(biao)(biao)(biao)中突(tu)出技(ji)術因素、相應(ying)增加權重。完善評(ping)(ping)標(biao)(biao)(biao)(biao)委員會否決(jue)異常投(tou)標(biao)(biao)(biao)(biao)文(wen)(wen)件(jian)(jian)的(de)甄別(bie)處理(li)程序(xu),評(ping)(ping)標(biao)(biao)(biao)(biao)委員會認為投(tou)標(biao)(biao)(biao)(biao)文(wen)(wen)件(jian)(jian)存(cun)在(zai)應(ying)否決(jue)投(tou)標(biao)(biao)(biao)(biao)情(qing)形的(de),應(ying)在(zai)否決(jue)投(tou)標(biao)(biao)(biao)(biao)前就(jiu)擬否決(jue)情(qing)形向投(tou)標(biao)(biao)(biao)(biao)人進行(xing)書面(在(zai)線)詢(xun)問,并(bing)書面(在(zai)線)記(ji)錄(lu)詢(xun)問情(qing)況(kuang)(kuang)和投(tou)標(biao)(biao)(biao)(biao)人反(fan)饋情(qing)況(kuang)(kuang)。招標(biao)(biao)(biao)(biao)人應(ying)根據項(xiang)目(mu)實際(ji)情(qing)況(kuang)(kuang)合理(li)選用評(ping)(ping)標(biao)(biao)(biao)(biao)評(ping)(ping)審方法(fa)(fa),并(bing)在(zai)招標(biao)(biao)(biao)(biao)文(wen)(wen)件(jian)(jian)中載明否決(jue)投(tou)標(biao)(biao)(biao)(biao)條款(kuan)。

8.創新評標(biao)(biao)(biao)機(ji)制。完善遠程(cheng)異(yi)地(di)評標(biao)(biao)(biao)管(guan)理辦法,推行省內(nei)遠程(cheng)異(yi)地(di)評標(biao)(biao)(biao)副場場地(di)、專家、機(ji)位(wei)“三隨(sui)機(ji)”抽取機(ji)制。鼓勵評定分離改革(ge),支持(chi)招標(biao)(biao)(biao)人(ren)(ren)從評標(biao)(biao)(biao)委員會推薦的(de)中(zhong)標(biao)(biao)(biao)候選人(ren)(ren)范圍內(nei)自主確定中(zhong)標(biao)(biao)(biao)人(ren)(ren),實行定標(biao)(biao)(biao)全(quan)過(guo)程(cheng)記(ji)錄并可追溯。探索機(ji)器智能輔助評標(biao)(biao)(biao)、工位(wei)制多點(dian)分散(san)評標(biao)(biao)(biao)、暗標(biao)(biao)(biao)評審,減少評標(biao)(biao)(biao)過(guo)程(cheng)中(zhong)的(de)人(ren)(ren)工干預因素(su)。

9.加強(qiang)評(ping)(ping)標專(zhuan)(zhuan)家(jia)全周期管(guan)理(li)(li)(li)(li)。優化評(ping)(ping)標專(zhuan)(zhuan)家(jia)專(zhuan)(zhuan)業(ye)(ye)分(fen)類,強(qiang)化評(ping)(ping)標專(zhuan)(zhuan)家(jia)入庫(ku)審查、業(ye)(ye)務培(pei)訓、廉(lian)潔教育,提升履職能力(li)。完善(shan)評(ping)(ping)標專(zhuan)(zhuan)家(jia)公正履職承諾、日(ri)常考核評(ping)(ping)價、保(bao)密管(guan)理(li)(li)(li)(li)、動(dong)態管(guan)理(li)(li)(li)(li)等制(zhi)度規范(fan),嚴(yan)格執行(xing)(xing)評(ping)(ping)標專(zhuan)(zhuan)家(jia)“一(yi)標一(yi)評(ping)(ping)”,實(shi)行(xing)(xing)評(ping)(ping)標專(zhuan)(zhuan)家(jia)對(dui)評(ping)(ping)標結果(guo)終身(shen)負(fu)責制(zhi)。定期開展評(ping)(ping)標專(zhuan)(zhuan)家(jia)清理(li)(li)(li)(li),對(dui)違法(fa)違規的評(ping)(ping)標專(zhuan)(zhuan)家(jia)依法(fa)嚴(yan)肅處(chu)(chu)理(li)(li)(li)(li),降低抽取概率(lv),并將處(chu)(chu)罰情況(kuang)通(tong)報其(qi)所在單位(wei)、入庫(ku)審查單位(wei)和評(ping)(ping)標專(zhuan)(zhuan)家(jia)庫(ku)管(guan)理(li)(li)(li)(li)單位(wei)。

四(si)、推進招(zhao)標投標數智化升(sheng)級

10.打造(zao)數智交(jiao)(jiao)易系(xi)統(tong)(tong)。積(ji)極(ji)應(ying)用大數據、云(yun)計算、人工智能(neng)、區塊鏈等新(xin)技術,推進江西省公共資(zi)源交(jiao)(jiao)易系(xi)統(tong)(tong)數智化重構升級,健全(quan)完善各(ge)行業招(zhao)標投標業務子系(xi)統(tong)(tong),優化全(quan)流程(cheng)(cheng)電子化交(jiao)(jiao)易功(gong)能(neng),實現交(jiao)(jiao)易編碼與(yu)固定(ding)資(zi)產投資(zi)項目代碼關聯(lian)應(ying)用,打造(zao)系(xi)列智能(neng)應(ying)用,加強交(jiao)(jiao)易過程(cheng)(cheng)中的實時(shi)監測預警。完善交(jiao)(jiao)易系(xi)統(tong)(tong)對接技術規范,有序開(kai)放對接符合要求的專業交(jiao)(jiao)易工具。

11.推(tui)進服(fu)(fu)務系統(tong)智慧(hui)化升級。依托全(quan)省(sheng)(sheng)統(tong)一的大(da)數據資(zi)源平(ping)臺,升級改造江西省(sheng)(sheng)公共資(zi)源交易服(fu)(fu)務系統(tong),與(yu)項目(mu)審批、行(xing)業監管(guan)、稅(shui)收社保、財政預算等平(ping)臺互(hu)(hu)聯(lian)互(hu)(hu)通,推(tui)動經營主體登記、資(zi)格、業績(ji)、信(xin)用等信(xin)息互(hu)(hu)認共享(xiang)。

12.推進(jin)數(shu)字證(zheng)書跨(kua)省互認(ren)(ren)。落實全國移動數(shu)字證(zheng)書(CA)互認(ren)(ren)技術標準(zhun),逐步實現與全國跨(kua)區域互認(ren)(ren),支持市場主(zhu)體(ti)在任(ren)一(yi)省份購買互認(ren)(ren)范圍內(nei)的移動數(shu)字證(zheng)書(CA),均可在我省參(can)與招標投(tou)標活動。

五、營(ying)造規范有序(xu)市場環境

14.規范(fan)電(dian)(dian)子(zi)投標(biao)擔保(bao)(bao)(bao)(bao)行為(wei)(wei)。全面推廣以電(dian)(dian)子(zi)保(bao)(bao)(bao)(bao)函(han)(保(bao)(bao)(bao)(bao)險(xian))等方式(shi)繳納投標(biao)保(bao)(bao)(bao)(bao)證金(jin)、履約保(bao)(bao)(bao)(bao)證金(jin)、工程質(zhi)量保(bao)(bao)(bao)(bao)證金(jin)。投標(biao)人采取電(dian)(dian)子(zi)保(bao)(bao)(bao)(bao)函(han)方式(shi)繳納投標(biao)保(bao)(bao)(bao)(bao)證金(jin)的(de),開具電(dian)(dian)子(zi)保(bao)(bao)(bao)(bao)函(han)的(de)手(shou)續費應(ying)當從(cong)投標(biao)人企(qi)業基本賬(zhang)戶(hu)以電(dian)(dian)匯或銀行轉賬(zhang)方式(shi)交至保(bao)(bao)(bao)(bao)函(han)開具人企(qi)業賬(zhang)戶(hu)。完善(shan)減免投標(biao)保(bao)(bao)(bao)(bao)證金(jin)、以信用承諾替代投標(biao)保(bao)(bao)(bao)(bao)證金(jin)(電(dian)(dian)子(zi)保(bao)(bao)(bao)(bao)函(han))等制(zhi)度(du),對存在(zai)違(wei)法違(wei)規等失(shi)信行為(wei)(wei)的(de)投標(biao)人,不得適用相關減免或替代政策。

15.完善招(zhao)標投(tou)(tou)(tou)標糾紛處理機制(zhi)(zhi)(zhi)。發揮(hui)調解(jie)、仲裁、訴(su)訟等爭(zheng)議解(jie)決機制(zhi)(zhi)(zhi)作用,支持經(jing)營主(zhu)體依據民事合同維護自身合法權益,推動招(zhao)標投(tou)(tou)(tou)標糾紛多(duo)元化解(jie)。遏制(zhi)(zhi)(zhi)惡意(yi)投(tou)(tou)(tou)訴(su)行(xing)(xing)為,投(tou)(tou)(tou)訴(su)人通過捏造事實、提(ti)供虛假材(cai)(cai)料、以(yi)非(fei)法手(shou)段取得證明材(cai)(cai)料進行(xing)(xing)投(tou)(tou)(tou)訴(su)的,由各級行(xing)(xing)業行(xing)(xing)政主(zhu)管(guan)部門記(ji)入不(bu)良行(xing)(xing)為記(ji)錄(lu)。對在一年內(nei)三次以(yi)上投(tou)(tou)(tou)訴(su)查無(wu)實據的惡意(yi)投(tou)(tou)(tou)標人,招(zhao)標人可以(yi)拒絕其(qi)參與投(tou)(tou)(tou)標活動。

16.持續清(qing)理妨礙統一大(da)市場建(jian)設和公平競爭的(de)(de)規(gui)(gui)定、做(zuo)法(fa)。定期開展招標(biao)投(tou)標(biao)法(fa)規(gui)(gui)政(zheng)(zheng)策(ce)文件清(qing)理,對法(fa)規(gui)(gui)、規(gui)(gui)章、政(zheng)(zheng)策(ce)文件、示范(fan)文本以(yi)及實(shi)際做(zuo)法(fa)進行全(quan)面排查,存在(zai)所(suo)有制(zhi)歧視、行業壁(bi)壘、地(di)方保護等不合理限制(zhi)的(de)(de),按規(gui)(gui)定權限和程序修(xiu)訂(ding)或廢止。規(gui)(gui)范(fan)招標(biao)投(tou)標(biao)領(ling)域(yu)行政(zheng)(zheng)審(shen)批(pi)、許可、備案、注冊(ce)、登記、報名等事(shi)項(xiang),沒有法(fa)律(lv)法(fa)規(gui)(gui)依據(ju)的(de)(de)予以(yi)廢止,不得以(yi)公共(gong)服(fu)務、交易服(fu)務等名義變相實(shi)施行政(zheng)(zheng)審(shen)批(pi)。

六、加強招標投標協同監管(guan)

17.壓(ya)實(shi)部(bu)門(men)(men)(men)責(ze)任。省發展改革委負責(ze)指導協調全省招(zhao)標(biao)投(tou)(tou)標(biao)工(gong)作(zuo),牽頭(tou)編制分領域(yu)的行(xing)政(zheng)(zheng)監(jian)(jian)督責(ze)任清單,推動主管(guan)(guan)部(bu)門(men)(men)(men)明確(que)監(jian)(jian)管(guan)(guan)范圍、程序、方(fang)式。對監(jian)(jian)管(guan)(guan)邊(bian)界模糊、職責(ze)存在爭議(yi)的,按照領域(yu)歸(gui)口、精簡高效原則明確(que)主管(guan)(guan)部(bu)門(men)(men)(men)和監(jian)(jian)管(guan)(guan)責(ze)任。工(gong)信、自然資源、住房城鄉建設、交通運(yun)輸、水利、農(nong)(nong)業農(nong)(nong)村等各(ge)行(xing)業行(xing)政(zheng)(zheng)主管(guan)(guan)部(bu)門(men)(men)(men)負責(ze)監(jian)(jian)督管(guan)(guan)理本行(xing)業招(zhao)標(biao)投(tou)(tou)標(biao)工(gong)作(zuo),建立健全層級(ji)監(jian)(jian)管(guan)(guan)制度(du),按權限(xian)監(jian)(jian)管(guan)(guan)具體(ti)招(zhao)標(biao)投(tou)(tou)標(biao)活動,依法處理投(tou)(tou)訴(su)舉報、查處違法違規行(xing)為(wei)。

18.推(tui)動全鏈條(tiao)全過(guo)(guo)程(cheng)監(jian)(jian)管(guan)(guan)。省級有關行(xing)(xing)(xing)業(ye)行(xing)(xing)(xing)政主(zhu)管(guan)(guan)部門(men)(men)應(ying)(ying)建立(li)貫通標(biao)(biao)前(qian)、標(biao)(biao)中、標(biao)(biao)后的(de)(de)全鏈條(tiao)監(jian)(jian)管(guan)(guan)機制,指導督(du)促(cu)本(ben)行(xing)(xing)(xing)業(ye)各(ge)(ge)級行(xing)(xing)(xing)政主(zhu)管(guan)(guan)部門(men)(men)進一步強(qiang)化項目全過(guo)(guo)程(cheng)監(jian)(jian)管(guan)(guan)。地(di)方各(ge)(ge)級行(xing)(xing)(xing)業(ye)行(xing)(xing)(xing)政主(zhu)管(guan)(guan)部門(men)(men)應(ying)(ying)牽頭落(luo)實好本(ben)行(xing)(xing)(xing)業(ye)的(de)(de)全過(guo)(guo)程(cheng)監(jian)(jian)管(guan)(guan)要求,嚴(yan)肅查處本(ben)行(xing)(xing)(xing)業(ye)的(de)(de)招(zhao)標(biao)(biao)投標(biao)(biao)違法違規行(xing)(xing)(xing)為(wei),依法加(jia)強(qiang)對(dui)合同訂立(li)、履行(xing)(xing)(xing)、變更(geng)的(de)(de)行(xing)(xing)(xing)政監(jian)(jian)管(guan)(guan),加(jia)大對(dui)招(zhao)標(biao)(biao)投標(biao)(biao)市場、項目建設(she)質量安(an)全檢查力度(du),強(qiang)化招(zhao)標(biao)(biao)投標(biao)(biao)交易市場與履約現場聯動,完(wan)善事(shi)前(qian)事(shi)中事(shi)后全鏈條(tiao)全領域監(jian)(jian)管(guan)(guan)。

19.強(qiang)化(hua)多部(bu)(bu)門立(li)體監(jian)(jian)管(guan)。各(ge)級(ji)(ji)行(xing)(xing)業(ye)(ye)(ye)行(xing)(xing)政(zheng)主(zhu)管(guan)部(bu)(bu)門進一步加(jia)強(qiang)與(yu)紀(ji)(ji)檢(jian)監(jian)(jian)察、發展改革、公安、司(si)法(fa)、審(shen)計(ji)、市場監(jian)(jian)管(guan)、綜合(he)行(xing)(xing)政(zheng)執(zhi)法(fa)等(deng)單位的(de)協(xie)同配合(he),健全(quan)行(xing)(xing)政(zheng)執(zhi)法(fa)與(yu)刑事司(si)法(fa)、審(shen)計(ji)監(jian)(jian)督等(deng)的(de)協(xie)同銜接(jie)。探索(suo)制定(ding)招(zhao)(zhao)(zhao)標(biao)(biao)投標(biao)(biao)行(xing)(xing)業(ye)(ye)(ye)行(xing)(xing)政(zheng)主(zhu)管(guan)部(bu)(bu)門與(yu)紀(ji)(ji)檢(jian)監(jian)(jian)察機關、司(si)法(fa)機關等(deng)移送線(xian)索(suo)的(de)標(biao)(biao)準、程序和協(xie)作機制,加(jia)強(qiang)案件協(xie)查配合(he),深化(hua)信(xin)息共享應(ying)用,強(qiang)化(hua)對本行(xing)(xing)業(ye)(ye)(ye)招(zhao)(zhao)(zhao)標(biao)(biao)人(ren)、招(zhao)(zhao)(zhao)標(biao)(biao)代理(li)(li)、投標(biao)(biao)人(ren)、評標(biao)(biao)專家等(deng)主(zhu)體的(de)監(jian)(jian)管(guan),加(jia)大(da)對違法(fa)違規(gui)行(xing)(xing)為(wei)的(de)查處力度。各(ge)級(ji)(ji)國(guo)資監(jian)(jian)管(guan)機構應(ying)將國(guo)有企業(ye)(ye)(ye)組(zu)織招(zhao)(zhao)(zhao)標(biao)(biao)和參與(yu)投標(biao)(biao)納入經營投資責(ze)任(ren)追究制度從嚴管(guan)理(li)(li)。

20.加(jia)快推進智慧監(jian)(jian)管(guan)(guan)(guan)。創新招標(biao)(biao)投標(biao)(biao)數字(zi)化(hua)(hua)監(jian)(jian)管(guan)(guan)(guan)方式,升級完善江西省公共資源(yuan)交易監(jian)(jian)管(guan)(guan)(guan)系統,優化(hua)(hua)圍標(biao)(biao)串(chuan)標(biao)(biao)、虛(xu)假(jia)投標(biao)(biao)等(deng)分析預警(jing)功(gong)能(neng),暢通行業行政(zheng)(zheng)主管(guan)(guan)(guan)部(bu)門、紀(ji)檢(jian)監(jian)(jian)察機關、司法機關、審計(ji)機關在線監(jian)(jian)管(guan)(guan)(guan)監(jian)(jian)督(du)通道(dao),建立開放協同(tong)的監(jian)(jian)管(guan)(guan)(guan)監(jian)(jian)督(du)網(wang)絡,推動現場(chang)監(jian)(jian)管(guan)(guan)(guan)向全流程數字(zi)化(hua)(hua)監(jian)(jian)管(guan)(guan)(guan)轉變。行業行政(zheng)(zheng)主管(guan)(guan)(guan)部(bu)門應建立完善數字(zi)化(hua)(hua)執法規則標(biao)(biao)準,運(yun)用(yong)(yong)非現場(chang)、物(wu)聯感知、掌上(shang)移動、穿透式等(deng)新型監(jian)(jian)管(guan)(guan)(guan)手(shou)段,進一步提升監(jian)(jian)管(guan)(guan)(guan)效(xiao)能(neng)。加(jia)大(da)招標(biao)(biao)文件隨機抽查(cha)力度,運(yun)用(yong)(yong)數字(zi)化(hua)(hua)手(shou)段強化(hua)(hua)同(tong)類(lei)項目資格(ge)、商務(wu)條件分析比對,發現異常招標(biao)(biao)文件,及時進行重點核查(cha)。

各(ge)(ge)地、省(sheng)(sheng)有關部門要根據(ju)職責,建立健全工作推(tui)進(jin)機制(zhi),認(ren)真貫徹落實(shi)(shi)本實(shi)(shi)施意見提出的各(ge)(ge)項任(ren)(ren)務(wu)和要求,探索公共(gong)資源交易市場化改革創(chuang)新。省(sheng)(sheng)發展改革委(wei)要強化統籌協調,清單化推(tui)進(jin)改革任(ren)(ren)務(wu)落實(shi)(shi),定期會(hui)同省(sheng)(sheng)有關部門總結提煉經(jing)驗(yan)做法(fa),以適當方式推(tui)廣(guang)應用。重大事項及時向省(sheng)(sheng)委(wei)、省(sheng)(sheng)政(zheng)府報告(gao)。
