民間投(tou)資(zi)是(shi)全(quan)社會投(tou)資(zi)的(de)重(zhong)要組成部分(fen),民營企業是(shi)上海市加(jia)快建(jian)設具有(you)世界(jie)影響(xiang)力的(de)社會主(zhu)義(yi)現代化國(guo)際(ji)大(da)都市的(de)耕耘者(zhe)、建(jian)設者(zhe)、分(fen)享者(zhe)。為(wei)切實(shi)落實(shi)“兩個毫不(bu)動(dong)搖”,進一步完善(shan)政策(ce)環境加(jia)大(da)力度(du)支(zhi)持民間投(tou)資(zi)發展,服務構建(jian)新發展格局(ju),推動(dong)高質量發展,結合(he)我市實(shi)際(ji),制定本政策(ce)措施。 一、營造公平的市場準入環境 1.落實統一的(de)市(shi)場(chang)(chang)準(zhun)(zhun)入(ru)制(zhi)度。對(dui)國(guo)家市(shi)場(chang)(chang)準(zhun)(zhun)入(ru)負面清單以外的(de)領域,支持民營(ying)企業(ye)依(yi)法平等(deng)進入(ru),依(yi)法開展投資。各(ge)區(qu)、各(ge)部(bu)(bu)門(men)推進民間投資服(fu)(fu)(fu)務(wu)(wu)標準(zhun)(zhun)化規(gui)范(fan)化建(jian)設,編制(zhi)服(fu)(fu)(fu)務(wu)(wu)辦(ban)(ban)事指南,細化服(fu)(fu)(fu)務(wu)(wu)標準(zhun)(zhun),明確(que)辦(ban)(ban)理時(shi)效,服(fu)(fu)(fu)務(wu)(wu)事項(xiang)辦(ban)(ban)理條(tiao)(tiao)件不得(de)含有兜底條(tiao)(tiao)款。在浦東新區(qu)試行市(shi)場(chang)(chang)準(zhun)(zhun)營(ying)承諾即入(ru)制(zhi)改革(ge),通過一次性告(gao)知市(shi)場(chang)(chang)主(zhu)體(ti)從事特(te)定行業(ye)許可經(jing)營(ying)項(xiang)目須具(ju)備的(de)全部(bu)(bu)條(tiao)(tiao)件和標準(zhun)(zhun),市(shi)場(chang)(chang)主(zhu)體(ti)書面承諾其已經(jing)符合要(yao)求并提交必要(yao)材料,即可取(qu)得(de)行政許可。(責(ze)任部(bu)(bu)門(men):市(shi)發展改革(ge)委(wei)、市(shi)商(shang)務(wu)(wu)委(wei)、市(shi)審(shen)改辦(ban)(ban)、各(ge)市(shi)級(ji)主(zhu)管(guan)部(bu)(bu)門(men)、各(ge)區(qu)政府) 2.支(zhi)持(chi)民間投資(zi)(zi)參(can)(can)與重(zhong)(zhong)大項目(mu)(mu)。建立健全重(zhong)(zhong)大項目(mu)(mu)發(fa)布和(he)重(zhong)(zhong)要政策宣傳推(tui)介機制,鼓勵民間資(zi)(zi)本參(can)(can)與我市列入國(guo)家“十四(si)五”規劃(hua)102項重(zhong)(zhong)大工程的項目(mu)(mu)及上海“十四(si)五”規劃(hua)重(zhong)(zhong)大項目(mu)(mu)。符合(he)條件的民間投資(zi)(zi)項目(mu)(mu),滾動列入年度市重(zhong)(zhong)大工程項目(mu)(mu)清單,由市重(zhong)(zhong)大辦負責(ze)(ze)協調推(tui)進。支(zhi)持(chi)民間投資(zi)(zi)與國(guo)有(you)資(zi)(zi)本聯合(he),通過合(he)資(zi)(zi)共設(she)(she)、股(gu)權(quan)轉讓(rang)、增資(zi)(zi)擴股(gu)等方式,共同(tong)參(can)(can)與重(zhong)(zhong)大項目(mu)(mu)投資(zi)(zi)建設(she)(she)。民營企業(ye)參(can)(can)與重(zhong)(zhong)大項目(mu)(mu)的設(she)(she)計(ji)、施工、原(yuan)材料、設(she)(she)施設(she)(she)備供應等,在(zai)招投標中一(yi)視同(tong)仁,堅決(jue)破除隱性壁壘。(責(ze)(ze)任部(bu)門:市發(fa)展(zhan)改革委、市工商聯、市住房城鄉(xiang)建設(she)(she)管(guan)理委、市重(zhong)(zhong)大辦、市國(guo)資(zi)(zi)委) 3.發揮政(zheng)府(fu)投(tou)資(zi)引(yin)導帶動作用。在政(zheng)府(fu)投(tou)資(zi)招(zhao)投(tou)標領(ling)(ling)域全(quan)面推(tui)行保函(保險(xian))替代現(xian)金繳納投(tou)標、履約、工程質(zhi)量(liang)等保證金。在企(qi)業(ye)投(tou)資(zi)領(ling)(ling)域投(tou)標、履約、工程質(zhi)量(liang)等保證金,不得拒絕(jue)使用保函。納入(ru)部門(men)預算管(guan)理的(de)(de)政(zheng)府(fu)采購(gou)(gou)工程項(xiang)目,預算主管(guan)部門(men)要在預算編制(zhi)環節統籌(chou)制(zhi)定(ding)面向中(zhong)小企(qi)業(ye)預留(liu)(liu)采購(gou)(gou)份額(e)方案,將政(zheng)府(fu)采購(gou)(gou)工程面向中(zhong)小企(qi)業(ye)的(de)(de)預留(liu)(liu)份額(e)階段性(xing)提高(gao)至(zhi)40%以上的(de)(de)政(zheng)策延續(xu)至(zhi)2023年底。(責任(ren)部門(men):市(shi)財政(zheng)局、市(shi)經濟信息化委(wei)(wei)、市(shi)住房城(cheng)鄉(xiang)建設管(guan)理委(wei)(wei)、上海銀保監(jian)局) 4.加快民間(jian)投(tou)(tou)資(zi)項(xiang)(xiang)目(mu)前期(qi)工作。修訂企業投(tou)(tou)資(zi)項(xiang)(xiang)目(mu)核(he)準(zhun)、備案目(mu)錄,進一(yi)步下(xia)放部分固(gu)定資(zi)產投(tou)(tou)資(zi)項(xiang)(xiang)目(mu)管理(li)權限。全(quan)面推(tui)(tui)進落實社會投(tou)(tou)資(zi)項(xiang)(xiang)目(mu)用地(di)清(qing)單制。納入建(jian)筑師負責(ze)制試點且已投(tou)(tou)保注(zhu)冊(ce)建(jian)筑師職業責(ze)任保險的項(xiang)(xiang)目(mu),經責(ze)任建(jian)筑師告知(zhi)承諾(nuo),在具(ju)備相(xiang)關審(shen)批要件(jian)后,施(shi)工圖審(shen)查合(he)格證(zheng)書(shu)不再作為建(jian)設工程施(shi)工許可(ke)核(he)發前置條件(jian)。鞏固(gu)提(ti)升“多測合(he)一(yi)”改(gai)革(ge)成效,全(quan)面推(tui)(tui)廣(guang)“樁基先行(xing)”,全(quan)面推(tui)(tui)進“水電氣(qi)網聯合(he)報(bao)裝”,推(tui)(tui)進民間(jian)投(tou)(tou)資(zi)一(yi)站式(shi)辦理(li)施(shi)工許可(ke),一(yi)次申(shen)請并聯審(shen)批,一(yi)次性核(he)發電子證(zheng)照。(責(ze)任部門:市(shi)發展改(gai)革(ge)委(wei)、市(shi)規劃資(zi)源局、市(shi)住房城鄉建(jian)設管理(li)委(wei)) 6.降低(di)企業用(yong)(yong)地(di)(di)(di)(di)成(cheng)本(ben)。優(you)化土地(di)(di)(di)(di)市場交(jiao)(jiao)易(yi)(yi)環節,對采(cai)取定向(xiang)掛牌以及(ji)僅有一人報名參(can)(can)與(yu)競(jing)拍(pai)的(de)出(chu)讓地(di)(di)(di)(di)塊,取消現場交(jiao)(jiao)易(yi)(yi)環節,民間投資(zi)可(ke)以直(zhi)接電子掛牌交(jiao)(jiao)易(yi)(yi)并確認(ren)競(jing)得。產業用(yong)(yong)地(di)(di)(di)(di)地(di)(di)(di)(di)價(jia)(jia)實(shi)行底線管(guan)理原則,工業用(yong)(yong)地(di)(di)(di)(di)最(zui)低(di)可(ke)按全國(guo)工業用(yong)(yong)地(di)(di)(di)(di)出(chu)讓最(zui)低(di)價(jia)(jia)標準(zhun)確定,研發(fa)用(yong)(yong)地(di)(di)(di)(di)最(zui)低(di)可(ke)按本(ben)市研發(fa)用(yong)(yong)地(di)(di)(di)(di)基準(zhun)地(di)(di)(di)(di)價(jia)(jia)出(chu)讓。彈性年(nian)期(qi)(qi)到期(qi)(qi)續期(qi)(qi)時的(de)土地(di)(di)(di)(di)價(jia)(jia)款(kuan),符合(he)(he)國(guo)土空間規(gui)(gui)(gui)劃(hua)和(he)產業發(fa)展規(gui)(gui)(gui)劃(hua)的(de),經集體決策,可(ke)按照原出(chu)讓合(he)(he)同約定價(jia)(jia)格,綜合(he)(he)評估確定續期(qi)(qi)價(jia)(jia)格。支持民間資(zi)本(ben)組(zu)建基金,參(can)(can)與(yu)存(cun)量產業園區轉型升(sheng)級,涉及(ji)規(gui)(gui)(gui)劃(hua)調整(zheng)給予(yu)支持。鼓勵(li)存(cun)量產業用(yong)(yong)地(di)(di)(di)(di)提(ti)容增(zeng)效,按照規(gui)(gui)(gui)劃(hua)和(he)產業導向(xiang),民間投資(zi)存(cun)量工業和(he)倉儲用(yong)(yong)地(di)(di)(di)(di)經批準(zhun)提(ti)高容積率(lv)和(he)增(zeng)加地(di)(di)(di)(di)下空間的(de),不再增(zeng)收土地(di)(di)(di)(di)價(jia)(jia)款(kuan)。(責任(ren)部(bu)門:市規(gui)(gui)(gui)劃(hua)資(zi)源局、市經濟信息(xi)化委)
