優化(hua)重大(da)基(ji)礎設施(shi)(shi)(shi)項目劃撥(bo)供地(di)程序。在(zai)國土空間規(gui)劃確定的城市和村莊、集鎮建設用(yong)(yong)(yong)地(di)范圍(wei)外的能源、交通、水利等(deng)重大(da)基(ji)礎設施(shi)(shi)(shi)項目,土地(di)征收和農用(yong)(yong)(yong)地(di)轉(zhuan)用(yong)(yong)(yong)經批準(zhun)實施(shi)(shi)(shi)后,直接(jie)核發國有土地(di)使用(yong)(yong)(yong)權劃撥(bo)決(jue)定書。 納入國家級規劃(hua)的機場、鐵路(lu)、公路(lu)、水運、能源、水利(li)項目,嚴格占用永久(jiu)基本農(nong)田。 全文如下: 自然資源部關于積極做好用地用海要素保障的通知 各省、自(zi)治區、直轄(xia)市(shi)及計劃單列市(shi)自(zi)然資源(海(hai)洋)主管部(bu)門,新疆生產(chan)建設兵團自(zi)然資源局: 為貫(guan)徹落(luo)實(shi)黨中(zhong)央關于疫情(qing)要(yao)(yao)防住(zhu)、經(jing)濟要(yao)(yao)穩住(zhu)、發展(zhan)要(yao)(yao)安(an)全的(de)(de)決策部署和國(guo)務院扎實(shi)穩住(zhu)經(jing)濟一攬子政策措(cuo)施的(de)(de)要(yao)(yao)求,結(jie)合國(guo)務院專(zhuan)項督查反饋(kui)的(de)(de)意見建議,在嚴(yan)格落(luo)實(shi)耕地保護制(zhi)(zhi)度、節約集約用地制(zhi)(zhi)度和生態環境保護制(zhi)(zhi)度,守住(zhu)法律底線和資源安(an)全紅(hong)線的(de)(de)前提(ti)下,切實(shi)做好建設項目用地用海保障,推(tui)進有效投資重(zhong)要(yao)(yao)項目盡快形成實(shi)物(wu)工作量(liang),促進經(jing)濟社會平穩健康發展(zhan),現(xian)就(jiu)建設項目落(luo)地涉及的(de)(de)用地用海階段性(xing)政策措(cuo)施通知如下。 一、強化國土空間規劃引領約束 1. 明確建設(she)項(xiang)(xiang)(xiang)目(mu)用(yong)(yong)(yong)地(di)(di)(di)用(yong)(yong)(yong)海(hai)審(shen)查(cha)(cha)的(de)(de)規(gui)(gui)(gui)(gui)劃(hua)依(yi)據。在(zai)(zai)國(guo)土(tu)空(kong)(kong)間(jian)(jian)規(gui)(gui)(gui)(gui)劃(hua)批復前,經依(yi)法批準的(de)(de)土(tu)地(di)(di)(di)利(li)用(yong)(yong)(yong)總體(ti)規(gui)(gui)(gui)(gui)劃(hua)、城鄉規(gui)(gui)(gui)(gui)劃(hua)、海(hai)洋功(gong)能區(qu)劃(hua)繼續執行,作為(wei)建設(she)項(xiang)(xiang)(xiang)目(mu)用(yong)(yong)(yong)地(di)(di)(di)用(yong)(yong)(yong)海(hai)審(shen)查(cha)(cha)的(de)(de)規(gui)(gui)(gui)(gui)劃(hua)依(yi)據。超出土(tu)地(di)(di)(di)利(li)用(yong)(yong)(yong)總體(ti)規(gui)(gui)(gui)(gui)劃(hua)、城鄉規(gui)(gui)(gui)(gui)劃(hua)、海(hai)洋功(gong)能區(qu)劃(hua)的(de)(de)建設(she)項(xiang)(xiang)(xiang)目(mu),應銜接(jie)“三(san)區(qu)三(san)線”等(deng)國(guo)土(tu)空(kong)(kong)間(jian)(jian)規(gui)(gui)(gui)(gui)劃(hua)管(guan)控(kong)要求,并(bing)將(jiang)項(xiang)(xiang)(xiang)目(mu)用(yong)(yong)(yong)地(di)(di)(di)用(yong)(yong)(yong)海(hai)布局及(ji)規(gui)(gui)(gui)(gui)模(mo)統籌納(na)入在(zai)(zai)編的(de)(de)國(guo)土(tu)空(kong)(kong)間(jian)(jian)規(gui)(gui)(gui)(gui)劃(hua)及(ji)“一張圖”(近期申報用(yong)(yong)(yong)地(di)(di)(di)時由(you)項(xiang)(xiang)(xiang)目(mu)所在(zai)(zai)地(di)(di)(di)縣級(ji)以上人民政(zheng)府附圖承諾(nuo)),可采用(yong)(yong)(yong)預支規(gui)(gui)(gui)(gui)劃(hua)規(gui)(gui)(gui)(gui)模(mo)的(de)(de)方式保障用(yong)(yong)(yong)地(di)(di)(di);涉及(ji)報國(guo)務院(yuan)批準用(yong)(yong)(yong)海(hai)的(de)(de)項(xiang)(xiang)(xiang)目(mu),應由(you)項(xiang)(xiang)(xiang)目(mu)所在(zai)(zai)地(di)(di)(di)省級(ji)人民政(zheng)府附圖承諾(nuo)納(na)入在(zai)(zai)編的(de)(de)國(guo)土(tu)空(kong)(kong)間(jian)(jian)規(gui)(gui)(gui)(gui)劃(hua)及(ji)“一張圖”。 2. 用(yong)(yong)(yong)(yong)好“三(san)區(qu)三(san)線(xian)”劃定成(cheng)果。“三(san)區(qu)三(san)線(xian)”劃定成(cheng)果經批(pi)(pi)(pi)準并(bing)納入國(guo)土(tu)空間規(gui)劃“一(yi)張(zhang)圖”后(hou),作為(wei)建(jian)設(she)項(xiang)(xiang)目(mu)用(yong)(yong)(yong)(yong)地(di)(di)用(yong)(yong)(yong)(yong)海(hai)(hai)組卷報批(pi)(pi)(pi)的(de)依據。建(jian)設(she)項(xiang)(xiang)目(mu)涉及生態保(bao)護(hu)紅(hong)線(xian),屬于允(yun)許有限(xian)人為(wei)活動的(de),新增建(jian)設(she)用(yong)(yong)(yong)(yong)地(di)(di)在農用(yong)(yong)(yong)(yong)地(di)(di)轉用(yong)(yong)(yong)(yong)、土(tu)地(di)(di)征收(shou)(shou)和用(yong)(yong)(yong)(yong)海(hai)(hai)審批(pi)(pi)(pi)時附省級人民(min)政(zheng)府(fu)符合允(yun)許有限(xian)人為(wei)活動的(de)意見;國(guo)家重(zhong)大項(xiang)(xiang)目(mu)確需(xu)占(zhan)用(yong)(yong)(yong)(yong)生態保(bao)護(hu)紅(hong)線(xian)的(de),省級人民(min)政(zheng)府(fu)提出(chu)農用(yong)(yong)(yong)(yong)地(di)(di)轉用(yong)(yong)(yong)(yong)、土(tu)地(di)(di)征收(shou)(shou)和用(yong)(yong)(yong)(yong)海(hai)(hai)審批(pi)(pi)(pi)申請(qing)時,同時附省級人民(min)政(zheng)府(fu)出(chu)具的(de)不可避讓論證意見,報國(guo)務院批(pi)(pi)(pi)準。國(guo)家重(zhong)大項(xiang)(xiang)目(mu)新增填海(hai)(hai)造地(di)(di)確需(xu)在生態保(bao)護(hu)紅(hong)線(xian)內(nei)實施(shi)的(de),省級人民(min)政(zheng)府(fu)同步(bu)編制生態保(bao)護(hu)紅(hong)線(xian)調(diao)整(zheng)方(fang)(fang)案并(bing)納入國(guo)土(tu)空間規(gui)劃“一(yi)張(zhang)圖”,調(diao)整(zheng)方(fang)(fang)案隨項(xiang)(xiang)目(mu)用(yong)(yong)(yong)(yong)海(hai)(hai)申請(qing)一(yi)并(bing)報國(guo)務院批(pi)(pi)(pi)準。 二、強化用地計劃指標保障 3.實行計劃指標重(zhong)(zhong)點保障。對納(na)入國家(jia)重(zhong)(zhong)大項(xiang)目(mu)(mu)清單、國家(jia)軍(jun)事設(she)施(shi)(shi)重(zhong)(zhong)大項(xiang)目(mu)(mu)清單的項(xiang)目(mu)(mu)用地,以及納(na)入省(sheng)級(ji)人民政府重(zhong)(zhong)大項(xiang)目(mu)(mu)清單的能源、交通、水(shui)利、軍(jun)事設(she)施(shi)(shi)、產業(ye)單獨選(xuan)址(zhi)項(xiang)目(mu)(mu)用地,由部直接配置(zhi)計劃指標。 4.繼續實施增存掛鉤(gou)。對未納入重大項(xiang)目清單的單獨選址項(xiang)目用地和城鎮村批(pi)次用地,使(shi)用以(yi)當(dang)年(nian)(nian)存量(liang)土地處置規模為(wei)基礎(chu)核算(suan)的計劃指(zhi)標(biao)(biao)。當(dang)季指(zhi)標(biao)(biao)不足(zu)的,可預支使(shi)用,年(nian)(nian)底(di)以(yi)省為(wei)單位統一核算(suan)。當(dang)年(nian)(nian)指(zhi)標(biao)(biao)不足(zu)的,可結轉使(shi)用前三年(nian)(nian)度節余指(zhi)標(biao)(biao)。 三、簡化建設項目規劃用地審批 5.縮小用(yong)地(di)(di)(di)預(yu)(yu)審范圍(wei)。以下情形(xing)不需申(shen)請(qing)(qing)辦(ban)理用(yong)地(di)(di)(di)預(yu)(yu)審,直(zhi)接申(shen)請(qing)(qing)辦(ban)理農用(yong)地(di)(di)(di)轉(zhuan)用(yong)和(he)土地(di)(di)(di)征(zheng)收(shou):(1)經依法批準的(de)(de)(de)國土空間規(gui)劃(hua)(含(han)土地(di)(di)(di)利(li)用(yong)總體規(gui)劃(hua))確定(ding)的(de)(de)(de)城市和(he)村莊、集鎮建設用(yong)地(di)(di)(di)范圍(wei)內的(de)(de)(de)建設項(xiang)目;(2)“探采(cai)(cai)合一”和(he)“探轉(zhuan)采(cai)(cai)”油氣(qi)類及鉆(zhan)井配套(tao)設施(shi)建設用(yong)地(di)(di)(di);(3)具備(bei)直(zhi)接出讓采(cai)(cai)礦權條(tiao)件(jian)、能(neng)夠明確具體用(yong)地(di)(di)(di)范圍(wei)的(de)(de)(de)采(cai)(cai)礦用(yong)地(di)(di)(di);(4)露天(tian)煤礦接續用(yong)地(di)(di)(di);(5)水利(li)水電(dian)項(xiang)目涉及的(de)(de)(de)淹沒區用(yong)地(di)(di)(di)。 6.簡化用地(di)預審(shen)(shen)審(shen)(shen)查(cha)(cha)。預審(shen)(shen)階(jie)段,涉及規劃土地(di)用途(tu)調整(zheng)的(de),重點審(shen)(shen)查(cha)(cha)是否符(fu)合允許(xu)調整(zheng)的(de)情形(xing),但(dan)在(zai)申請辦理農用地(di)轉(zhuan)用和(he)土地(di)征收時,須提交(jiao)規劃土地(di)用途(tu)調整(zheng)方案;涉及占(zhan)用生態保護紅線的(de),重點審(shen)(shen)查(cha)(cha)是否符(fu)合允許(xu)有限(xian)人為(wei)活動(dong)之外的(de)國家重大項(xiang)目范圍。 7.支持國家重(zhong)大項(xiang)目(mu)先(xian)行(xing)用(yong)地。國家重(zhong)大項(xiang)目(mu)中,控制工期(qi)的(de)單體工程和因(yin)工期(qi)緊或受(shou)季節(jie)影(ying)響確需(xu)動工建(jian)設(she)的(de)其他工程,可申請辦理先(xian)行(xing)用(yong)地。 8.分(fen)(fen)(fen)期分(fen)(fen)(fen)段(duan)辦理(li)農用(yong)(yong)(yong)地(di)(di)轉(zhuan)用(yong)(yong)(yong)和土(tu)地(di)(di)征(zheng)收(shou)。確需分(fen)(fen)(fen)期建設(she)(she)的項目(mu),可(ke)根(gen)據可(ke)行性研究報(bao)(bao)告確定(ding)的方案(an)或可(ke)行性研究批復中明(ming)確的分(fen)(fen)(fen)期建設(she)(she)內(nei)容,分(fen)(fen)(fen)期申請(qing)建設(she)(she)用(yong)(yong)(yong)地(di)(di)。線性基礎設(she)(she)施建設(she)(she)項目(mu)正(zheng)式報(bao)(bao)批用(yong)(yong)(yong)地(di)(di)時,可(ke)根(gen)據用(yong)(yong)(yong)地(di)(di)報(bao)(bao)批組卷進(jin)度,以市(地(di)(di)、州、盟)分(fen)(fen)(fen)段(duan)報(bao)(bao)批用(yong)(yong)(yong)地(di)(di)。農用(yong)(yong)(yong)地(di)(di)轉(zhuan)用(yong)(yong)(yong)和土(tu)地(di)(di)征(zheng)收(shou)均在(zai)省(sheng)級人民政府權限內(nei)的,可(ke)以縣(xian)(市、區)為單位分(fen)(fen)(fen)段(duan)報(bao)(bao)批用(yong)(yong)(yong)地(di)(di)。 9.規(gui)(gui)范調(diao)(diao)整(zheng)用(yong)(yong)地(di)(di)(di)(di)(di)(di)(di)(di)(di)審(shen)批(pi)(pi)。線性(xing)工程(cheng)建(jian)設過程(cheng)中因地(di)(di)(di)(di)(di)(di)(di)(di)(di)質災害、文物(wu)保(bao)護等不可(ke)抗力(li)因素確需調(diao)(diao)整(zheng)用(yong)(yong)地(di)(di)(di)(di)(di)(di)(di)(di)(di)范圍的(de),經批(pi)(pi)準(zhun)項目的(de)行業(ye)主管部門(men)同意后,建(jian)設單位(wei)可(ke)申請(qing)調(diao)(diao)整(zheng)農用(yong)(yong)地(di)(di)(di)(di)(di)(di)(di)(di)(di)轉用(yong)(yong)和(he)(he)土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)(di)(di)征收(shou)(shou)。項目建(jian)設方案(an)調(diao)(diao)整(zheng),調(diao)(diao)整(zheng)后的(de)項目用(yong)(yong)地(di)(di)(di)(di)(di)(di)(di)(di)(di)總(zong)(zong)面(mian)積(ji)、耕(geng)(geng)地(di)(di)(di)(di)(di)(di)(di)(di)(di)和(he)(he)永久基本農田(tian)規(gui)(gui)模(mo)均不超原批(pi)(pi)準(zhun)規(gui)(gui)模(mo),或者項目用(yong)(yong)地(di)(di)(di)(di)(di)(di)(di)(di)(di)總(zong)(zong)面(mian)積(ji)和(he)(he)耕(geng)(geng)地(di)(di)(di)(di)(di)(di)(di)(di)(di)超原規(gui)(gui)模(mo)、但(dan)調(diao)(diao)整(zheng)部分(fen)未超出省級人民(min)(min)政(zheng)(zheng)府土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)(di)(di)征收(shou)(shou)批(pi)(pi)準(zhun)權限的(de),報省級人民(min)(min)政(zheng)(zheng)府批(pi)(pi)準(zhun);調(diao)(diao)整(zheng)后的(de)項目用(yong)(yong)地(di)(di)(di)(di)(di)(di)(di)(di)(di)涉(she)及調(diao)(diao)增(zeng)永久基本農田(tian),或征收(shou)(shou)耕(geng)(geng)地(di)(di)(di)(di)(di)(di)(di)(di)(di)超過35公頃、其它土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)(di)(di)超過70公頃,應(ying)當報國務院批(pi)(pi)準(zhun)。調(diao)(diao)整(zheng)用(yong)(yong)地(di)(di)(di)(di)(di)(di)(di)(di)(di)涉(she)及新(xin)征收(shou)(shou)土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)(di)(di)的(de),應(ying)當依法(fa)履行征地(di)(di)(di)(di)(di)(di)(di)(di)(di)程(cheng)序,不再使用(yong)(yong)的(de)土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)(di)(di),可(ke)交由原集(ji)體經濟組織使用(yong)(yong)。省級人民(min)(min)政(zheng)(zheng)府批(pi)(pi)準(zhun)調(diao)(diao)整(zheng)用(yong)(yong)地(di)(di)(di)(di)(di)(di)(di)(di)(di)后,應(ying)納入國土(tu)(tu)空間規(gui)(gui)劃“一張(zhang)圖”實(shi)施(shi)監管,并及時報自然資源部備案(an)。 10.落實臨(lin)時(shi)用(yong)(yong)地政策(ce)。建設周(zhou)期較長的(de)能源、交通、水利等基礎設施建設項(xiang)目施工(gong)使用(yong)(yong)的(de)臨(lin)時(shi)用(yong)(yong)地,期限不超(chao)過(guo)(guo)四(si)年。直接服務于鐵路工(gong)程施工(gong)的(de)制(zhi)梁場(chang)、拌(ban)合站,需臨(lin)時(shi)使用(yong)(yong)土地的(de),其土地復(fu)墾(ken)方案通過(guo)(guo)論證,業(ye)主單位簽訂承諾書,明確(que)了復(fu)墾(ken)完成時(shi)限和恢復(fu)責任(ren),確(que)保能恢復(fu)種(zhong)植條件的(de),可以(yi)占(zhan)用(yong)(yong)耕(geng)地,不得占(zhan)用(yong)(yong)永久基本農田。 11.簡化規(gui)(gui)劃許可申(shen)請(qing)材料與程序。深化“多(duo)規(gui)(gui)合一”基礎(chu)上的(de)規(gui)(gui)劃用(yong)地“多(duo)審(shen)合一、多(duo)證(zheng)合一”改(gai)革,核發統(tong)一的(de)建(jian)(jian)設項(xiang)目用(yong)地預審(shen)與選址(zhi)意(yi)見書,簡化辦理建(jian)(jian)設用(yong)地規(gui)(gui)劃許可、建(jian)(jian)設工程規(gui)(gui)劃許可、鄉村建(jian)(jian)設規(gui)(gui)劃許可,不得隨(sui)意(yi)增加(jia)許可條件、申(shen)請(qing)材料、中介服務、審(shen)批環節、收費、數量限(xian)制等(deng),推(tui)進規(gui)(gui)劃許可服務標準化、規(gui)(gui)范化、便利化。 12.積(ji)極推進建(jian)設項目“多測合一(yi)”改(gai)革。按照同一(yi)標的(de)物只測一(yi)次原則,整合優化測繪事項,后續(xu)階段充(chong)分共享已經形成的(de)測繪成果(guo)。鼓勵公平競爭,打破市場(chang)壟斷。 四、明確建設項目占用耕地和永久基本農田相關政策 13.嚴格占用(yong)永(yong)久基本農田的重(zhong)(zhong)大建(jian)設項(xiang)(xiang)目(mu)(mu)(mu)范圍。(1)黨中央(yang)、國(guo)(guo)務院明(ming)確支持的重(zhong)(zhong)大建(jian)設項(xiang)(xiang)目(mu)(mu)(mu);(2)按《關于梳(shu)理國(guo)(guo)家重(zhong)(zhong)大項(xiang)(xiang)目(mu)(mu)(mu)清(qing)單(dan)加大建(jian)設用(yong)地(di)保障力(li)度(du)(du)的通(tong)知》(發改投(tou)資〔2020〕688號)要求,列(lie)入需中央(yang)加大用(yong)地(di)保障力(li)度(du)(du)清(qing)單(dan)的項(xiang)(xiang)目(mu)(mu)(mu);(3)中央(yang)軍委及其有關部(bu)門批準的軍事國(guo)(guo)防(fang)類項(xiang)(xiang)目(mu)(mu)(mu);(4)納入國(guo)(guo)家級規劃的機場、鐵路、公路、水運、能(neng)源、水利項(xiang)(xiang)目(mu)(mu)(mu);(5)省(sheng)(sheng)級公路網規劃的省(sheng)(sheng)級高(gao)速(su)公路和連接原(yuan)深度(du)(du)貧困(kun)(kun)地(di)區直接為該地(di)區服務的省(sheng)(sheng)級公路項(xiang)(xiang)目(mu)(mu)(mu);(6)原(yuan)深度(du)(du)貧困(kun)(kun)地(di)區、集中連片特困(kun)(kun)地(di)區、國(guo)(guo)家扶貧開發工作重(zhong)(zhong)點縣省(sheng)(sheng)級以下基礎設施、民生發展等項(xiang)(xiang)目(mu)(mu)(mu)。 14.允許國(guo)(guo)家重(zhong)(zhong)大(da)項(xiang)目(mu)以承(cheng)(cheng)諾(nuo)(nuo)方(fang)式(shi)落實(shi)耕(geng)地占補平(ping)(ping)衡。對黨中央(yang)、國(guo)(guo)務院以及國(guo)(guo)務院推進有效投(tou)資重(zhong)(zhong)要項(xiang)目(mu)工作協調機(ji)制確定的(de)國(guo)(guo)家重(zhong)(zhong)大(da)建(jian)設項(xiang)目(mu),允許以承(cheng)(cheng)諾(nuo)(nuo)方(fang)式(shi)落實(shi)耕(geng)地占補平(ping)(ping)衡。省級人民政府(fu)應(ying)當(dang)明確兌現承(cheng)(cheng)諾(nuo)(nuo)的(de)期限和落實(shi)補充耕(geng)地方(fang)式(shi)。兌現承(cheng)(cheng)諾(nuo)(nuo)期限原(yuan)則上不超過2年,到期未(wei)兌現承(cheng)(cheng)諾(nuo)(nuo)的(de),部直接從補充耕(geng)地儲(chu)備庫(ku)中扣減指標。上述承(cheng)(cheng)諾(nuo)(nuo)政策有效期至(zhi)2023年3月(yue)底。 15.擴大補充耕地(di)(di)來源。支持各地(di)(di)結(jie)(jie)合(he)農(nong)業結(jie)(jie)構(gou)調整,將平原地(di)(di)區非耕地(di)(di)逐步恢(hui)復為(wei)耕地(di)(di),其中(zhong)“二調”不是耕地(di)(di)的,新增耕地(di)(di)可以用于占補平衡。 16.統籌(chou)落實(shi)永(yong)久(jiu)基(ji)本(ben)(ben)農田補(bu)劃(hua)。建(jian)設項目經依(yi)法批準占(zhan)用永(yong)久(jiu)基(ji)本(ben)(ben)農田的(de),在(zai)永(yong)久(jiu)基(ji)本(ben)(ben)農田儲(chu)備區耕地中(zhong)補(bu)劃(hua);儲(chu)備區中(zhong)難以補(bu)足的(de),在(zai)縣(xian)域范(fan)(fan)圍(wei)(wei)(wei)內(nei)其他優質耕地中(zhong)補(bu)劃(hua);縣(xian)域范(fan)(fan)圍(wei)(wei)(wei)內(nei)無法補(bu)足的(de),可(ke)在(zai)市域范(fan)(fan)圍(wei)(wei)(wei)內(nei)補(bu)劃(hua);市域范(fan)(fan)圍(wei)(wei)(wei)內(nei)無法補(bu)足的(de),可(ke)在(zai)省(sheng)域范(fan)(fan)圍(wei)(wei)(wei)內(nei)補(bu)劃(hua)。優先將完成高標準農田建(jian)設的(de)耕地補(bu)劃(hua)為永(yong)久(jiu)基(ji)本(ben)(ben)農田。 五、落實節約集約用地 17.做好項(xiang)目用地節(jie)地評(ping)價。超(chao)(chao)標(biao)準(zhun)(zhun)、無標(biao)準(zhun)(zhun)項(xiang)目用地要嚴格執行《關(guan)(guan)于規范(fan)開展建設項(xiang)目節(jie)地評(ping)價工(gong)作的(de)通(tong)知》(自(zi)然(ran)(ran)資辦發〔2021〕14號)。重大(da)項(xiang)目中(zhong)公路項(xiang)目設置的(de)互通(tong)立體交(jiao)叉工(gong)程用地,超(chao)(chao)過《公路工(gong)程項(xiang)目建設用地指(zhi)標(biao)》有關(guan)(guan)間距(ju)規定的(de),省級(ji)自(zi)然(ran)(ran)資源主(zhu)管部門應開展節(jie)地評(ping)價論(lun)證并(bing)取得省級(ji)以上交(jiao)通(tong)主(zhu)管部門出具的(de)意見。 18.鼓勵低效(xiao)用(yong)(yong)地再開(kai)發(fa)。建設項目使用(yong)(yong)城鎮低效(xiao)用(yong)(yong)地的,可(ke)以繼續按照(zhao)《關于深入推進城鎮低效(xiao)用(yong)(yong)地再開(kai)發(fa)的指導意見(試行)》(國(guo)土資發(fa)〔2016〕147號)有(you)關規定執行。 六、優化土地供應 19.積極推行“標準(zhun)地(di)”供應(ying)。按照(zhao)供地(di)即可開(kai)(kai)工的原則,推行產(chan)(chan)業用(yong)地(di)“標準(zhun)地(di)”出(chu)讓機制(zhi)。在(zai)土地(di)供應(ying)前,由地(di)方政府或依法(fa)設立的開(kai)(kai)發(fa)區(園區)和新區的管理機構(gou)統一開(kai)(kai)展地(di)質災害、壓覆礦產(chan)(chan)、環境影響(xiang)、水土保持、洪水影響(xiang)、文物考古(gu)等(deng)評估(gu)和普查(cha)。土地(di)用(yong)途、規劃條件和相關控制(zhi)指標應(ying)通過出(chu)讓公(gong)告公(gong)開(kai)(kai)發(fa)布,并納入土地(di)出(chu)讓合同。 20.優化重大基礎(chu)設(she)施(shi)項目劃撥(bo)供地(di)程(cheng)序。在國土空間規(gui)劃確定(ding)的城(cheng)市和(he)村(cun)莊、集鎮建(jian)設(she)用(yong)(yong)地(di)范(fan)圍外的能源、交通(tong)、水利等(deng)重大基礎(chu)設(she)施(shi)項目,土地(di)征收(shou)和(he)農用(yong)(yong)地(di)轉(zhuan)用(yong)(yong)經(jing)批準(zhun)實施(shi)后(hou),直接核(he)發國有土地(di)使(shi)用(yong)(yong)權劃撥(bo)決定(ding)書。 七、優化用海用島審批 21.先行開展(zhan)(zhan)項目(mu)用(yong)(yong)海用(yong)(yong)島論證材(cai)料技(ji)術審查。為加快(kuai)審批,對(dui)暫(zan)不具(ju)備受理條件的(de)項目(mu),先行開展(zhan)(zhan)用(yong)(yong)海用(yong)(yong)島論證和專家評審等技(ji)術審查工作。 22.優(you)化海(hai)底(di)電纜(lan)管道鋪(pu)設(she)施工和項目用(yong)海(hai)審批程序。報國務院(yuan)審批的海(hai)底(di)電纜(lan)管道項目,海(hai)底(di)電纜(lan)管道鋪(pu)設(she)施工申請(qing),可與項目用(yong)海(hai)申請(qing)一并提交(jiao)審查。路由調查勘測申請(qing)審批仍(reng)按原規(gui)定執行。 23.項(xiang)目用(yong)海(hai)(hai)(hai)與(yu)填(tian)(tian)海(hai)(hai)(hai)項(xiang)目竣工(gong)海(hai)(hai)(hai)域(yu)使(shi)用(yong)驗(yan)(yan)收一并審查。對利用(yong)已(yi)填(tian)(tian)成陸歷史遺留(liu)圍(wei)填(tian)(tian)海(hai)(hai)(hai)、無(wu)新增圍(wei)填(tian)(tian)海(hai)(hai)(hai)的項(xiang)目,可在提(ti)交海(hai)(hai)(hai)域(yu)使(shi)用(yong)申(shen)(shen)請材料時一并提(ti)交竣工(gong)驗(yan)(yan)收測量(liang)報(bao)(bao)告(gao)(gao),海(hai)(hai)(hai)域(yu)使(shi)用(yong)論(lun)證報(bao)(bao)告(gao)(gao)與(yu)竣工(gong)驗(yan)(yan)收測量(liang)報(bao)(bao)告(gao)(gao)合并審查。在項(xiang)目用(yong)海(hai)(hai)(hai)批準并全額繳(jiao)納(na)海(hai)(hai)(hai)域(yu)使(shi)用(yong)金(jin)后,對填(tian)(tian)海(hai)(hai)(hai)竣工(gong)驗(yan)(yan)收申(shen)(shen)請直接下達批復。 24.精簡技術評估報告(gao)。報國務院審(shen)批(pi)的海(hai)底(di)電纜管道項目(mu),海(hai)底(di)電纜管道路(lu)由調查勘測報告(gao)與海(hai)域(yu)使用論證報告(gao)合并編制。選址位于集中(zhong)連片的已填(tian)成陸歷(li)史遺留圍填(tian)海(hai)區域(yu)的項目(mu),均屬于省級人民政府審(shen)批(pi)權(quan)限的,地方可結合實際,實行打捆(kun)整體論證。 25.允許臨(lin)時(shi)用(yong)(yong)海(hai)續(xu)期。因(yin)疫情、自然災害(hai)等特殊原因(yin)導致臨(lin)時(shi)用(yong)(yong)海(hai)活動無法(fa)按期開展的(de),經批準(zhun),允許相(xiang)關臨(lin)時(shi)用(yong)(yong)海(hai)活動續(xu)期一次。 26.簡化項(xiang)目用(yong)(yong)島(dao)審批。對(dui)助航導(dao)航、測量、氣象觀測、海(hai)(hai)洋監(jian)測和地(di)震監(jian)測等公益設施用(yong)(yong)島(dao),可(ke)簡化無居(ju)民海(hai)(hai)島(dao)開發(fa)利用(yong)(yong)具體方(fang)案(an)和項(xiang)目論證報告。
